Terms of Use
This agreement is an electronic record under the Information Technology Act, 2000 and the rules made under it, as amended from time to time. It is generated by a computer system and does not require any physical or digital signature.
Please read these Terms of Use carefully. They are a binding contract between Sakayika Entertainment LLP and you, and govern your use of Mendikot Mehfil. If these Terms conflict with any other document, these Terms prevail unless we notify you of a change.
1. Introduction
Welcome to Mendikot Mehfil, a mobile game for playing the card game Mendikot, owned and operated by Sakayika Entertainment LLP, a limited liability partnership registered under the laws of India.
By downloading, installing or using the Application, you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy, which together govern your relationship with us. If you do not agree with any part of these Terms, do not use the Application, and uninstall it.
2. Definitions
- "Applicable Laws" means all statutes, rules, regulations, notifications, guidelines, directions and orders of any government, statutory authority, tribunal, board or court in India.
- "Application" means the mobile application named Mendikot Mehfil, and any updates to it, owned, operated and managed by us.
- "Sakayika Entertainment LLP", "we", "us" and "our" mean Sakayika Entertainment LLP, a limited liability partnership registered under the Limited Liability Partnership Act, 2008, having its office at Flat No-73, Dhanishtha Bldg, Tarangan Tower-1, Mangal Pandey Marg, Thane (West) 400606, Maharashtra, India, and its successors and assigns.
- "Services" means the Mendikot game and related features offered through the Application, including ranked and practice matches, the ladder, leaderboards and achievements, and any features we add from time to time.
- "User", "Player", "you" and "your" mean any individual who downloads or uses the Application on an iOS or Android device.
- "Chai" means the in-game energy used to enter matches, described in section 7.
3. Eligibility
You must be at least 12 years old to use the Application. If you are under the age of majority where you live, you may use the Application only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. We may change eligibility requirements at any time.
4. Your account
- You sign in with your Google account (Android), Sign in with Apple (iOS) or an Epic Games account. Sign-in is provided through Epic Online Services. Creating an account is free.
- You choose an in-game name. It must not be offensive, misleading, impersonate anyone, or infringe anyone's rights. We may change or remove names that break these rules.
- You are responsible for keeping your sign-in account secure and for all activity on your account. One person, one account: do not share, sell or transfer accounts.
- We will never ask for your password, OTP, PIN, card details, PAN or Aadhaar number. Do not share them with anyone claiming to represent us. We are not responsible for losses caused by sharing them.
5. The service
- The Application lets you play Mendikot on Android and iOS in multiplayer matches against other players and in practice matches, in several hukum (trump) modes.
- The Application is for entertainment only. You agree to play fairly and in good spirit.
- Matches require an internet connection. Online play depends on game servers, which may occasionally be unavailable.
- We maintain your account, progress and statistics as described in the Privacy Policy.
- We may add, change, suspend or discontinue any part of the Services, including game modes, rules, ratings, rewards and Chai values, at our discretion and without prior notice.
6. No real money, no gambling
Mendikot Mehfil is a free-to-play game of skill for entertainment. There are no stakes, wagers, entry fees, cash prizes or real-money winnings of any kind. Nothing in the Application constitutes betting or gambling under Applicable Laws. You must not use the Application, your account, results or rankings for betting, wagering or any commercial purpose, including arranging stakes on matches outside the Application.
7. Chai and in-game items
- Chai is in-game energy spent to enter ranked and practice matches. You earn Chai through daily bonuses and by choosing to watch rewarded ads. We set and may change how much Chai matches cost and rewards grant, and any daily limits.
- Chai, ratings, achievements and any other in-game items are a limited, revocable licence to use a feature of the Application. They have no monetary value, cannot be bought for or exchanged into real money or anything of value, and cannot be sold, traded or transferred.
- The current version of the Application has no in-app purchases. If we introduce purchases in future, they will be processed by the App Store or Google Play under their terms, and we will update these Terms before doing so.
- Chai or items obtained through bugs, exploits, automation or other abuse may be removed, and the account involved may be suspended.
8. Ustad bots
To keep matches starting quickly, empty seats may be filled by computer-controlled players called Ustads. Ustads are always clearly labelled at the table. Matches with Ustads may count towards your rating and statistics in the manner described in the Application.
9. Fair play and prohibited conduct
You agree not to:
- Cheat or collude: share information about your cards with another player by any means outside the Application's Ishara signals (for example by phone, messaging app or sitting together), deliberately lose or throw matches, farm rating or rewards with other accounts, or play with more than one account at the same table.
- Tamper: use bots, scripts, macros, modified or unofficial clients, emulators to gain an advantage, or tools that read or change game data or network traffic; or reverse engineer, decompile or disassemble the Application except where the law expressly allows it.
- Exploit: exploit bugs or glitches instead of reporting them to us, or manipulate ads to obtain Chai without genuinely completing them.
- Break the law or others' rights: use the Application for any illegal purpose, or infringe intellectual property, confidentiality or privacy rights.
- Harm others: use offensive, hateful, abusive or discriminatory in-game names, harass or intimidate other players, or impersonate any person or entity, including us.
- Disrupt the service: upload malicious code, overload or interfere with our servers or networks, attempt unauthorised access to any account, data or system, or deliberately abandon matches to disrupt other players.
- Spam or solicit: use the Application to send advertising, promotional material or other unsolicited communications.
We may investigate suspected breaches using match records, including Ishara signals and Insaaf IDs, and may void results, reset ratings, remove Chai or items, or suspend or terminate accounts. Security breaches may result in civil or criminal liability, and we may involve law enforcement where appropriate.
10. Advertisements
The Application shows third-party advertisements, including banners during matches and optional rewarded video ads. Ads are provided by Google AdMob and its partners. An advertisement is not an endorsement by us, and we are not responsible for any dealings between you and an advertiser. How ad data is handled, and your consent choices, are described in the Privacy Policy.
11. App stores
You obtain the Application from the Apple App Store or Google Play ("App Store"). Your use of the Application is also subject to that App Store's terms, which you must comply with. The App Store is not responsible for the Application or its support. If you downloaded the Application from the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Device permissions
The Application needs internet access to play online. On iOS, it may ask for permission to use your device's advertising identifier. You can grant or deny permissions and change them later in your device settings. If we add features that need other permissions, the Application will ask you first.
13. Privacy
We handle your information as described in our Privacy Policy, which forms part of these Terms.
14. Intellectual property
All content in the Application, including software, text, images, 3D models, graphics, logos, trademarks, audio and video, belongs to us or our licensors. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Application on your devices for personal, non-commercial entertainment. You may not copy, modify, reverse engineer, republish, upload, transmit or distribute any part of the Application without our prior written permission. The Mendikot Mehfil name and logo are the property of Sakayika Entertainment LLP and may not be used without our written consent. All rights not expressly granted are reserved.
15. Disclaimer of warranties
You use the Application at your own risk. The Application and Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Application will meet your requirements, be available without interruption or be error-free or secure, or that results, ratings or statistics will be accurate.
We may suspend the Application for maintenance, updates or support without liability. We are not responsible for: errors or inaccuracies in content; personal injury or property damage from your use of the Application; unauthorised access to our servers or the information stored on them; interruption of transmission to or from the Application; bugs, viruses or similar harmful code transmitted by third parties; or loss or damage arising from any content made available through the Application or from any product or service advertised in it.
16. Healthy play
Excessive gaming can be harmful. Please take regular breaks and play in moderation. You are responsible for managing your own playing habits, and we are not liable for the consequences of excessive play.
17. Limitation of liability
To the fullest extent permitted by law, neither we nor our partners, officers, employees or agents will be liable for any direct, indirect, incidental, special, punitive, consequential or exemplary damages (even if advised of the possibility) arising from your use or misuse of, or inability to use, the Application, or its interruption, suspension, modification or termination, including loss of progress, Chai, ratings or data. This applies equally to damages arising from advertisements or links in the Application. We are not liable for the content or conduct of other players or third parties, including offensive or illegal conduct, and the risk of harm from it rests with you. Nothing in these Terms excludes liability that cannot be excluded under Applicable Laws.
18. Indemnity
You agree to indemnify and hold us harmless against all losses, expenses, damages, claims and costs, including reasonable legal fees, arising from: content you submit (such as your in-game name); your violation of another person's rights; infringement of third-party intellectual property; your breach of these Terms or Applicable Laws; or your misuse or unauthorised use of the Application.
19. Suspension and termination
We may suspend or terminate your access to the Application at any time, with or without notice, if you breach these Terms or where we reasonably believe it is necessary to protect other players, the Services or us. We are not obliged to monitor conduct, but may do so. You may stop using the Application at any time and ask us to delete your account.
On termination, your licence to use the Application ends and any Chai, ratings and items on your account are forfeited without compensation. We may retain data after termination as permitted or required by Applicable Laws and our Privacy Policy. Sections on no gambling, intellectual property, disclaimers, limitation of liability, indemnity and governing law survive termination.
20. Use outside India
The Application is operated from India. If you use it from outside India, you do so at your own risk and are responsible for complying with local laws. We make no representation that the Application is suitable or available for use in any particular location.
21. Changes to these Terms
We may change these Terms at any time. We will post the updated Terms on this page and notify you in the Application when a change is material. Continued use of the Application after a change means you accept the updated Terms. If you do not agree, your remedy is to stop using and uninstall the Application.
22. Customer support and grievances
For support, complaints or grievances about the Services or these Terms, email support@sakayika.com. Complaints are handled by email. Our Grievance Officer can be contacted at the same address, or by post at the office address in section 2. We acknowledge grievances within 48 hours and aim to resolve them within 30 days.
23. Miscellaneous
Governing law and jurisdiction. These Terms are governed by the laws of India. Acceptance of these Terms is deemed to have taken place at Thane, Maharashtra, and the courts at Thane have exclusive jurisdiction over any proceedings relating to them.
Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including internet, equipment, system, software or telecommunication failures, hacking, virus attacks, strikes, government action, epidemics, floods, storms, power failures, civil disturbances or riots.
Assignment. We may assign our rights and obligations under these Terms without your consent. You may not assign yours.
No waiver. Our failure to enforce any provision is not a waiver of it.
Severability. If any provision is held invalid or unenforceable, the rest remains in effect.
No agency. No joint venture, partnership, employment or agency relationship exists between you and us.
Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Application, and replace any earlier communications or agreements on this subject.
